UPDATE: ULP Dismissal (Firefighter Eck)

Please find attached a letter that I received today from FLRA Regional Director John Pannozzo dismissing the ULP charge filed by Ryan Eck. The Regional Director concluded, consistent with the position statement that we submitted on the Local’s behalf, that the Union acted consistently with prior practice when it elected not to take Eck’s grievance to arbitration. Therefore, the Local’s actions were reasonable and not discriminatory or in bad faith and, accordingly, the Local did not violate its duty of fair representation. Eck has the right to appeal this decision to the FLRA General Counsel. If we receive any additional correspondence on this matter, we will promptly let you know.
